1. THE CONTRACT

By buying a ticket or booking one of our tours, you agree to these terms and conditions. These terms apply to all trips and events organized by «til Svartisen» , «nyt Svartisen» , or «Explore Svartisen».

By booking with us, you agree to our terms and conditions. If there are any differences between these terms and any specific agreement we have, the specific agreement will take priority, as long as it follows the law.

In addition to these terms, the agreement will be subject to any relevant consumer protection laws.

2. THE PARTIES

and will be referred to as the Seller from now on.

The Buyer is the person who places the order or makes the purchase, and will be called the Buyer from now on.

3. TICKET PURCHASE, BOOKINGS AND RESERVATIONS

This agreement becomes binding on both parties when the buyer purchases a ticket or submits their order. However, the agreement is not binding if there was a typo in the seller’s offer on the website or in the buyer’s order, and the other party realized or should have realized that there was a mistake.

Tickets can be purchased on board or pre-booked through our website, email, phone, or through our partners, including hotels, travel agencies, and third-party websites.

When registering on behalf of multiple participants, the purchaser is responsible for communicating the terms and conditions to each individual participant and is liable for payment. The purchaser must be over 18 years of age to make a booking.

4. PAYMENT TERMS AND CONDITIONS

The price you see is the total price you pay. This includes all taxes and extra costs.

The buyer shall not be liable for any additional costs that the seller has not disclosed prior to the purchase.

Boat charters and day excursions

Full payment for chartered tours must be made before departure. If paying by credit or debit card, the seller may reserve the purchase amount on the card at the time of booking. The card will be charged on the day of departure.

Invoices will be issued after the completion of the tour. The payment deadline is a minimum of 14 days from receipt. Please note that invoices cannot be issued to customers under the age of 18.

Scheduled tours with Isprins

For our scheduled routes, roundtrip fares can be paid either on board or in advance through our online booking system.

5. CANCELLATIONS AND REFUND POLICY

“The customer has the right to cancel tours booked in advance. Written notification of cancellation must be sent to post@tilsvartisen.no at least 24 hours before the scheduled departure of the tour or boat. The cancellation is considered effective upon receipt of the email by the seller.

“Tickets purchased via our online booking platform are eligible for a full refund within 24 hours of purchase. After 24 hours, a 50% refund may be granted, provided the tour has not begun. No refunds will be issued for cancellations made within 24 hours of departure.

No-show / Absence without notice

In the event of a no-show or late arrival without prior notice and approval from the seller, no refund will be provided for a booked tour.

Cancellations and modifications made by the seller

Although unlikely, the seller reserves the right to cancel or modify tours and events due to unforeseen circumstances. In the event of such a cancellation or modification, the purchaser will be notified promptly in writing via email and online postings.

Examples of situations that could force us to cancel or modify our tours:

  • To few participants
    In the event that the minimum participant requirement for a tour is not met, we may cancel the tour.
  • Weather conditions
    in the event of inclement weather or unsafe trail conditions, we reserve the right to change or cancel a tour.
  • Illness or injury to staff members
    In the event of illness or injury to a staff member during a booked tour, we will do our best to provide a replacement with equivalent expertise. However, if we are unable to conduct the planned tour as a result of the guide’s or tour leader’s illness or injury, a full refund of the paid amount will be issued.”
  • Damage to the vessel and equipment
    In the event of vessel damage or equipment failure during a booked tour, we will make every effort to provide alternative arrangements. However, if we are unable to conduct the agreed tour as a result of vessel damage or equipment failure, a full refund of the paid amount will be issued
  • Force majeure
    In the event of force majeure, such as fire, extreme weather, natural disasters, terrorist attacks, political unrest, or other events beyond our reasonable control, we shall be entitled to terminate this agreement without incurring any liability.

6. CUSTOMER RESPONSIBILITIES

You are responsible for reading and understanding our terms and conditions, and the descriptions of each tour and event.

Duty to disclose one’s health and physical condition.

You are responsible for ensuring that you are fit to participate in our tours. All participants must inform us/the crew of any medical conditions that could impact their safety or the safety of others.

Duty to comply with instructions given by the skipper/crew/event organizer.

The skipper and crew are ultimately responsible for your safety on our tours. To help ensure your safety, you agree to follow all instructions given by the skipper, crew, guides, or tour leaders.

7. ACCEPTANCE OF RISK

There is always a risk of accidents and injuries when participating in our tours, even though we take every precaution to minimize it.

By participating in our tours, you acknowledge and accept the inherent risks involved.

We are not liable for any damages caused by travelers or due to circumstances beyond our control, such as force majeure, unless the damages are a result of our gross negligence.

8. INSURANCE POLICY

Travel insurance for individual participants is not part of our tour package.

Travel insurance and cancellation insurance

We do not provide cancellation, travel, or accident insurance. Travelers are responsible for their own coverage.

9. COMPLAINTS AND COMPLAINT DEADLINES

Complaints about any problems with our services must be sent to «Svartisen AS» right away. If you don’t, you lose your right to complain. Your complaint must be in writing and sent to us promptly.

10. PRIVACY POLICY

On regular scheduled routes and advertised day trips, we only gather anonymous statistics regarding the number and types of passengers.

We collect names, postal addresses, phone numbers, email addresses, and booking information for all chartered trips.

The information we have about you comes directly from you. Whether you send us an email, fill out a form on our website, or call us, you are the one providing us with the information. We do not collect information about you from other sources

Why do we collect information about you?

We use the personal information you provide to deliver the services you have requested from us. Additionally, we use this information for customer management, invoicing, and accounting purposes.

Where and how is our data stored? What security measures are taken to protect the information?

To protect your data as best as possible, all information about you is stored in our central email system. This means we do not have any copies of the data on individual computers.

Our third-party payment processor handles the secure transmission and processing of credit card information for all on-board transactions.

For what period of time do we retain your information?

We will retain your personal data for no longer than is necessary for the purposes for which the personal data are processed.

Do we share your personal data with third parties?

We limit the sharing of your personal data to local partners and our own guides who are directly involved in providing the tour or event you have booked.

  • Our accountant
    To comply with accounting regulations, some of your personal information (name, email, address) may be stored by our accountant. This data is kept for a specific period as required by law, and then it will be securely deleted. Any other personal information that is not required for accounting purposes will be deleted within one month.

You have the right to access, rectify, and erase your data.

You have the right to:
Access the personal data we hold about you.
Request correction of any inaccurate personal data we hold.
Request erasure of your personal data, unless we have a legal obligation (e.g., for accounting purposes) to retain it.

11. CHOICE OF LAW AND VENUE

All disputes, controversies or claims arising out of or in connection with this agreement shall be resolved in accordance with the laws of Norway. Should the dispute not be settled amicably, the courts of the company’s place of business shall have jurisdiction. You hereby agree that Salten District Court shall be the exclusive venue for any dispute arising out of or in connection with this agreement.
